Terms of Service

You, the player (“You”), hereby agree by accessing our services, playing on our servers and/or accessing any of the content we offer, to be bound by this agreement, stay bound by this agreement, either by virtue and binding upon yourself, your agent and/or a person with control over yourself such as a parent and/or legal guardian.

As a result of the foregoing, you hereby agree as follows:

1. ELIGIBILITY TO USE OUR SERVICES

You, hereby, agree that:

A. You are above the age of thirteen (13) by the time you access our services, content and/or multiplayer server, and you access such with the consent of your parent and/or legal guardian.

B. You are above the age of eighteen (18) by the time you access our services, content and/or multiplayer server.

C. You have an original, premium Minecraft account purchased directly through Mojang AB and/or retailers and the given Minecraft account is owned by you.

D. You have read our rules, multiplayer rules and regulations and/or related policies that regulate your performance, actions and/or related to our services, multiplayer server and/or content.

E. You are currently able to access our services, multiplayer server and/or content and are not presently banned and/or prohibited from accessing such.

2. ACCOUNT AND SECURITY

You, hereby, agree that:

A. Your Minecraft account is secured, and only you hold access to such account; if you have provided access to such account to another person and/or entity, such access was willingly, and you are bound by the actions and consequences of their actions by using your account.

B. You shall ensure that your account remains secure and protected.

C. You shall be liable for any actions committed by your account either by your own use and/or the use of another person and/or entity, either to whom you’ve provided access and/or that was gained irregularly.

3. USABILITY AND ACCESSIBILITY

You, hereby, agree that:

A. We may at any time suspend, terminate, cancel and/or shut down any of our services, multiplayer server and/or content at any time, either with notice, without notice and/or immediately at any given time or set time, without providing you with any access to your goods and use of our services, multiplayer server and/or content.

B. We may, where you have contravened any of our rules, policies and/or regulations, ban you from our services, multiplayer server and/or content with notice and/or without notice; furthermore, we shall, at our own discretion, determine if such ban is permanent and/or temporary.

C. In the event we terminate, suspend, cancel and/or shut down our services, multiplayer server and/or content, and such will be without liability to you, you agree that where such occurs, you shall not be entitled to a refund, restitution and/or remission; as a result, you had at all points had access to any purchases you’ve made, use of such purchases and have agreed and acknowledged that such purchases are not permanent and/or valid into perpetuity. Likewise, the same applies if you are banned or temporarily banned as per paragraph 2.B above.

4. INTELLECTUAL PROPERTY

A. Subjected to the provisions of these terms, no portion in any shape, form or interpretation shall grant you ownership, a license and/or the rights to use any of our intellectual property for any purpose other than to access services, multiplayer server and/or content for pleasure means, which inter aliaincludes “gaming” and “enjoyment” in a form that would result in the natural use of Minecraft.

B. At all material times, any intellectual property of our services, multiplayer server and/or content we shall be the lawful and rightful owner in full of any of such; as a result, you are not entitled to alter, delete and/or modify our intellectual property, nor claim any ownership thereof.

C. Where applicable and if applicable, you shall not be granted ownership of any property, digital content and/or digital services where you have purchased on our online store, as a result, you are merely provided access to use and enjoy such digital content and/or digital services, we shall hold no liability towards you, nor does such purchase convey any intellectual property rights to you.

5. OUR SECURITY

A.       Although we attempt to ensure the protection and safety of all players like yourself, we cannot guarantee that all information, access to our services, multiplayer server and content shall be without any infringement of your security; as a result, you agree that:

i. You shall ensure that your account remains protected and secured.

ii. You shall ensure that your connected social media accounts and non-connected social media accounts, such as discord, twitter and/or youtube, are secured.

iii. You shall not share access to any party that would influence and/or cause you harm.

iv. Not to cause any harm to our infrastructure, such as using our services, multiplayer server and/or content in a manner that is contra to its purpose.

v. Use any hacks, cheats and/or third-party applications that would harm your account or other players and/or exploit our services, multiplayer server and/or content.

vi. Exploit any of our services, multiplayer server and/or content.  vii.    Breach any of our rules, policies or regulations.

viii. Use our services, multiplayer server and/or content in a manner that is inconsistent with the laws and regulations of the governing country and that of your home country.

ix. Act in a manner that would harm us, such as act dishonestly, commit fraud and/or misrepresent your interest in our services, multiplayer server and/or content.

6. PURCHASES AND RELATED

A. Where applicable and if applicable, you shall not be granted ownership of any property, digital content and/or digital services that you have purchased on our online store; as a result, you are merely provided access to use and enjoy such digital content and/or digital services, we shall hold no liability towards you, nor does such purchase convey any intellectual property rights to you.

B. You agree not to charge back any purchase made for any reason, as a result, should you make a chargeback that is unwarranted and/or based on misrepresentation of fraud, we reserve the right to dispute such chargeback and hold you liable for any costs associated with such.

C. You agree that you make such a purchase freely and voluntarily; every purchase is final.

D. You agree that where you make any purchase for any digital content and/or digital services, you shall be above the age of eighteen (18), or in the event you are younger, you have parental content and/or that of your legal guardian, and they have agreed to these terms.

E. You shall be liable for any taxes and/or fees associated with any purchase.

7. LIABILITY

You, hereby, agree that:

A. That in no shape, or form shall we be liable for any direct, indirect, incidental, consequential and/or special damages for any use, access and/or purchase of our services, multiplayer server and/or content; furthermore, we shall not be liable for any damages, loss or any of such which may or can be related to your use, access and/or purchase.

B. You further agree that you shall indemnify us and hold us harmless against any and all claims which may be applicable either by yourself, third parties and/or your agents and/or person with responsibility; further, you agree to hold harmless ourselves, our company directors, employees and/or agents and/or related persons, from any claim, damages, liabilities and/or losses and harm, which may or can relate to:

i.      Your use of our services, multiplayer server and/or content.

ii.     Your actions or non-actions and/or negligence.

iii.    Actions or non-actions and/or negligence from any person that accesses your account(s), either with consent and/or irregularly. C. You agree that we hold no duty to protect or identify yourself.

8. GENERAL PROVISIONS

A. The governing jurisdiction of Ras Al Khaimah, United Arab Emirates, shall regulate these terms and conditions of use.

B. Ras Ai Khaimah, without reference to any conflict of laws principles that would require the application of the laws of any other jurisdiction

C. Suppose any term or other provision of this agreement is invalid, illegal or incapable of being enforced by any rule of Law or public policy. In that case, all other conditions and provisions of this agreement shall nevertheless remain in full force and effect so long as the economic or legal substance of the transactions contemplated hereby is not affected in any manner adverse to either party. Upon such determination that any term or other provision is invalid, illegal or incapable of being enforced, the parties hereto shall negotiate in good faith to modify this agreement so as to effect the original intent of the parties as closely as possible in an acceptable manner, to the end that the transactions contemplated hereby are fulfilled to the extent possible.

D. No purported amendment to any provision of this agreement shall be binding upon the parties to this agreement unless both parties have agreed to such in writing.

E. No purported waiver of any provision of this agreement shall be binding upon any of the parties to this agreement unless upon the party providing such waiver has duly executed and delivered to the other parties a written instrument which states that it constitutes a waiver of one or more provisions of this agreement and specifies the provision(s) that are being waived. Any such waiver shall be effective only to the extent specifically set forth in such written instrument. Neither the exercise (from time to time and at any time) by a party of, nor the delay or failure (at any time or for any period of time) to exercise, any right, power or remedy shall constitute a waiver of the right to exercise, or impair, limit or restrict the exercise of, such right, power or remedy or any other right, power or remedy at any time and from time to time thereafter. No waiver of any right, power or remedy of a party shall be deemed to be a waiver of any other right, power or remedy of such party or shall, except to the extent so waived, impair, limit or restrict the exercise of such right, power or remedy.

F. No party shall be responsible for delays or failure to perform its duties resulting from acts of god.
